1. Agreement to Terms

By purchasing any product from StageScape Projections, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not purchase or use our products.

2. License of Use

 

Upon purchase, you are granted a non-exclusive, non-transferable, time-limited licence to use the product solely for the school or theatre company specified during the purchase process (the “Authorised Organisation”).

 

This licence permits use of the product only during the performance dates supplied at the time of purchase, including any technical rehearsals and dress rehearsals directly associated with those performances.

Any use of the product outside the declared performance period, including reuse for future productions or extended seasons not disclosed at purchase, constitutes unauthorised use and copyright infringement.

A new licence must be purchased for any additional performance dates, remounts, tours, or future productions.

3. Restrictions on Use

3.1 The product may not be copied, shared, resold, or otherwise transferred to any third party, including other schools, theatre companies, or individuals.

3.2 The product may not be modified, edited, or altered in any way without prior written consent from StageScape Projections.

3.3 Use of the product is limited to theatrical and educational productions staged by the Authorized Organization.

4. Copyright and Intellectual Property

All products created and distributed by StageScape Projections are protected by copyright and other intellectual property laws. Ownership of the product remains with StageScape Projections at all times.

5. Refunds

Our products are digital downloads delivered instantly upon purchase. As such, we do not offer refunds for change of mind once a file has been delivered.

However, our products come with guarantees that cannot be excluded under the Australian Consumer Law. If a product is faulty, corrupted, or materially different from its description, you are entitled to a remedy. In these circumstances, StageScape Projections will, at its discretion, provide a replacement file or a refund.

To request a remedy, please contact us within 14 days of purchase with a description of the issue. We may request additional information to assess your claim.

Please note that the following do not constitute grounds for a refund: change of mind, failure to read the product description before purchasing, incompatibility with your existing software or hardware, or failure to use the product.

Nothing in these terms is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law.

6. Technical Responsibility Disclaimer

StageScape Projections provides the digital artwork only and takes no responsibility for the technical setup, operation, or integration of the product into your production. You are solely responsible for ensuring that your technical equipment and software are compatible and functional. StageScape Projections is not liable for any technical failures, errors, or inability to use the product due to issues with your setup.

7. Breach of Terms

Any breach of these Terms, including unauthorized sharing or transfer of the product to third parties, constitutes copyright infringement. StageScape Projections reserves the right to pursue legal action, including seeking damages and injunctive relief, against any party found in violation of these Terms.

8. Indemnity

You agree to indemnify and hold harmless StageScape Projections, its owners, employees, and agents, from and against any claims, losses, damages, or expenses (including legal fees) arising out of your breach of these Terms or the use of the product.

9. Termination

StageScape Projections reserves the right to terminate the license granted under these Terms at any time if a breach is identified. Upon termination, you must cease all use of the product and destroy all copies in your possession.

10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [your jurisdiction], and any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in [your location].

11. Credit Requirements

11.1 Proper credit for the projection designs must be given in any marketing and promotional materials where the production creatives are credited, including but not limited to posters, programs, websites, and social media posts.

11.2 The credit must appear as follows: David Horne – StageScape Projections under the role of Projection Designer.

11.3 Credits must not be omitted or altered in a manner that implies or directly attributes the designs to another individual or organization.

12. Amendments
StageScape Projections reserves the right to amend these Terms and Conditions at any time. Notice of changes will be provided via our website or email, and continued use of the products constitutes acceptance of the updated Terms.
